Terms of Service

Introduction

1.1 These Terms of Service (“Terms”) govern your access to and use of drsatyanarayanagarre.in (“Platform”), operated by Dr. Satyanarayana Garre, for booking and attending online consultations with Dr. Satyanarayana Garre, Consultant Nephrologist (“Doctor”). “You” or “Patient” means the person booking an Appointment, whether for themselves or, where permitted, on behalf of another person under their care.

1.2 By creating an account, booking an Appointment, or otherwise using the Platform, you agree to be bound by these Terms, our Privacy Policy, and our Cancellation and Refund Policy, each of which is incorporated into these Terms by reference.

1.3 If you do not agree to these Terms, please do not use the Platform.

Definitions

2.1 “Booking” or “Appointment” means a consultation slot with the Doctor reserved through the Platform upon successful payment of the Consultation Fee and receipt of a Confirmation.

2.2 “Consultation Fee” means the amount charged to the Patient at the time of Booking.

2.3 “Confirmation” means the SMS, email, WhatsApp, or in-app notification sent once payment is successfully processed.

2.4 “Services” means the registration, appointment booking, online consultation, and related services made available through the Platform.

2.5 “Content” means any text, document, image, or other material uploaded to, or generated through, the Platform, including by you.

Eligibility and Account Registration

3.1 You must be at least 18 years old to register on the Platform in your own right. A Booking for a minor or a dependent adult must be made by their parent or legal guardian, who is responsible for the accuracy of the information provided and, where appropriate, for being present or reasonably available during the consultation.

3.2 You agree to provide accurate, current, and complete information at registration and at the time of Booking, including your name, email address, and mobile number, and to keep this information up to date.

3.3 You are responsible for keeping any OTP, password, or login credential confidential, and for all activity that occurs through your account. Notify us immediately of any unauthorised use of your account.

Nature of the Services — Important Medical Disclaimer

4.1 The Platform facilitates online (telemedicine) consultations with the Doctor, a Registered Medical Practitioner. Consultations are provided in accordance with the Telemedicine Practice Guidelines, 2020 issued by the Board of Governors/National Medical Commission, and the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002.

4.2 The Platform is not intended for medical emergencies. If you are experiencing a medical emergency, call your local emergency services or go to the nearest hospital immediately. Do not rely on the Platform for emergency or life-threatening conditions.

4.3 The mode of consultation (video, audio, or text, as applicable), and whether a particular condition is suitable for teleconsultation at all, is determined by the Doctor’s professional judgment. The Doctor may, at their discretion, recommend an in-person examination instead of, or in addition to, a teleconsultation.

4.4 Any prescription issued is at the sole clinical discretion of the Doctor, and in accordance with the categories of medicines permitted to be prescribed through teleconsultation under applicable guidelines. The Doctor may decline to prescribe certain medications remotely where an in-person examination is required.

4.5 You are responsible for providing accurate and complete information about your symptoms, medical history, and any documents uploaded. The quality of medical advice provided depends on the accuracy and completeness of the information you share.

4.6 Nothing in these Terms limits the Doctor’s professional responsibility for the standard of medical care provided, which continues to be governed by applicable medical practice and negligence law, independent of these Terms.

Booking, Fees, Cancellation, and Refunds

5.1 Appointments are confirmed only upon successful payment of the Consultation Fee and receipt of a Confirmation.

5.2 Cancellation, rescheduling, and refunds are governed by our separate Cancellation and Refund Policy, available at https://www.drsatyanarayanagarre.in/cancellation-and-refund-policy, which forms part of these Terms by reference. In the event of any conflict between that Policy and these Terms on those subjects, the Cancellation and Refund Policy will prevail.

5.3 Payments are processed through Razorpay. We do not store your full card, UPI, or bank account details; these are handled directly by the payment gateway.

Document Uploads and Content

6.1 You may upload prescriptions, lab reports, scans, or other documents to assist the Doctor ahead of or during the consultation, in the formats and size limits specified on the Platform.

6.2 You confirm that any document or information you upload is genuine, accurate, and either your own or that you have the right to share it (for example, where you are booking on behalf of a dependant).

6.3 You agree not to upload any file that contains malicious code, infringes a third party’s rights, or is unlawful, obscene, or harmful.

6.4 We use Content you upload only for the purpose of the consultation and related record-keeping, as described in our Privacy Policy.

Acceptable Use

7.1 You agree not to:

(a) impersonate any person, or misrepresent your identity or relationship to the Patient;

(b) attempt to gain unauthorised access to the Platform, other accounts, or our systems;

(c) use the Platform for any unlawful purpose, or to harass, abuse, or defraud any person;

(d) interfere with the proper functioning of the Platform, including by introducing viruses or malicious code; or

(e) use automated means, such as bots or scrapers, to access the Platform without our prior written consent.

7.2 We may suspend or terminate your access to the Platform, with or without notice, if we reasonably believe you have violated these Terms.

Intellectual Property

8.1 The Platform, including its design, text, graphics, logo, and software, is owned by drsatyanarayanagarre.in and/or the Doctor and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of this intellectual property to you.

8.2 You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without prior written permission, other than for your personal, non-commercial use in connection with booking and attending an Appointment.

Third-Party Services

9.1 The Platform relies on third-party services, including payment gateways, video consultation tools, and messaging, SMS, and email providers, to deliver the Services. We are not responsible for outages, errors, or failures of these third-party services that are beyond our reasonable control, save as set out in our Cancellation and Refund Policy regarding verified technical failures on the Platform’s own side.

9.2 Your use of third-party services accessed through the Platform, such as the payment gateway or video consultation tool, may also be subject to that provider’s own terms and privacy policy.

Limitation of Liability

10.1 To the maximum extent permitted by applicable law, the Platform is provided on an “as available” basis, and we do not guarantee that it will be uninterrupted, error-free, or secure at all times.

10.2 To the maximum extent permitted by applicable law, neither the Platform nor drsatyanarayanagarre.in will be liable for any indirect, incidental, or consequential loss arising from your use of the Platform, except in cases of gross negligence, wilful misconduct, or as otherwise required by applicable consumer protection law.

10.3 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Indian law, including the Consumer Protection Act, 2019, or the Doctor’s liability for the standard of medical care provided.

Indemnity

11.1 You agree to indemnify and hold harmless drsatyanarayanagarre.in and the Doctor from any claim, loss, or expense arising from your breach of these Terms, your misuse of the Platform, or information you have provided that is false, inaccurate, or misleading.

Force Majeure

12.1 Neither the Platform nor the Doctor is liable for any failure or delay in performance caused by circumstances beyond reasonable control, as described in our Cancellation and Refund Policy.

Termination

13.1 You may stop using the Platform at any time. We may suspend or terminate your account for breach of these Terms, suspected fraud, or as required by law, without affecting any Appointment already validly confirmed, save as provided in Clause 7.2.

Changes to these Terms

14.1 We may revise these Terms from time to time. The updated Terms take effect once published on the Platform; continuing to use the Platform after that date constitutes acceptance of the revised Terms.

Governing Law and Jurisdiction

16.1 These Terms are governed by the laws of India. Courts at Hyderabad, Telangana, have exclusive jurisdiction over any dispute arising from them.

Severability and Entire Agreement

17.1 If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

17.2 These Terms, together with our Privacy Policy and Cancellation and Refund Policy, constitute the entire agreement between you and drsatyanarayanagarre.in in relation to the Services.

Acceptance

18.1 By registering on, or using, the Platform, you confirm having read, understood, and agreed to these Terms of Service in their entirety.
